American DJ Sues NSI Audio
On May 13, American DJ filed suit in the U.S. District Court Central District of California against NSI Audio, a California-based company that sells and distributes products under several brand names.
The legal action is centered on two trademarks recently adopted by NSI: Vertigo lighting products and American Vocal audio products. The suit alleges that NSI used product and brand names that were the same or similar to those used by American DJ. It also alleges that NSI used copyrighted images belonging to the American DJ.
“There were a variety of deceptive practices used to imply that American DJ was the source of lighting and audio products being sold by NSI when, in fact, this was completely untrue,” said Kenneth Sherman, one of the attorneys representing American DJ from the law firm of Myers, Andras, Sherman. “In fact, these deceptive practices were done without American DJ’s knowledge or consent.”
American DJ is seeking monetary rewards and statutory damages. The company is also demanding that NSI stop selling the products in question, remove them from distribution and destroy all copyrighted images that have been used in its marketing and advertising.
