Ace Pro’s $1 Billion Suit Thrown Out
A United States District Court Judge in Florida ruled on Sept. 26 that the Ace Pro Sound & Recording $1 billion lawsuit brought against Guitar Center, GC’s CEO Marty Albertson, Yamaha Corp. of America, Korg, Electro-Voice, Tascam, JBL and St. Louis Music/Mackie has been dismissed with prejudice, and the suit is over.
The dismissal occurred nearly two years after the initial suits were filed. The original case dates back to Nov. 29, 2005. In the period that followed, the complaints were amended and revised numerous times. With each revision and judgment by the court, the claims against Guitar Center continued to narrow in focus, ultimately culminating in the full dismissal.
With this dismissal, Fred Rubin, former owner of Miami’s Ace Pro, has acknowledged “that this suit was about misunderstanding and poor communication and had nothing to do with the violation of any state or federal laws. This simply was not a matter for the courts.”
